1.2 Applicability

These terms and conditions apply to all purchases made through the Luxeparel webshop located at www.luxeparel.com. By placing an order through our webshop, you accept these Terms and Conditions in full.

1.3 Language

In case of any discrepancy between different language versions of these terms and conditions, the English version shall prevail.

2. PRODUCTS AND SERVICES

2.1 Nature of products

Luxeparel specializes in curated second-hand designer fashion items including clothing, shoes, bags, and accessories. All items offered for sale are pre-owned unless explicitly stated otherwise.

2.2 Product descriptions

Each item is carefully described on our website including details about the brand, size, condition, color, material, and any visible signs of wear. We make every effort to provide accurate descriptions and photographs of each item.

2.3 Condition grading

Items are sold in various conditions ranging from excellent to good. The specific condition of each item is clearly stated in the product description. Please read the condition description carefully before making a purchase.

2.4 Authenticity guarantee

All luxury items sold through Luxeparel are guaranteed to be authentic. Selected items have been verified through Entrupy authentication technology. Items found to be non-authentic will be refunded in full including original shipping costs.

2.5 “As-is” sale

All items are sold “as-is” based on the condition description provided on the website. While we describe items accurately and in detail, second-hand items may have minor imperfections not visible in photographs or not mentioned in the description. By purchasing from Luxeparel, you acknowledge and accept that items are pre-owned and may show normal signs of wear consistent with their age and use.

2.6 Availability

All items are unique pieces available in single units. Items are offered subject to availability. If an item becomes unavailable after you place an order, we will notify you immediately and provide a full refund.

3. PRICES AND PAYMENT

3.1 Prices

All prices shown on the Luxeparel website are in Euros (EUR) and include Belgian VAT at the applicable rate. Prices are subject to change without notice. The price applicable is the price displayed at the time you place your order.

3.2 Shipping costs

Shipping costs are calculated at checkout based on the destination country and the weight and dimensions of your order. Shipping costs are clearly displayed before you complete your purchase.

3.3 Payment methods

We accept the following payment methods through our secure payment provider Mollie: Bancontact, Credit Card (Visa, Mastercard), PayPal, Klarna and Pluxee. Payment must be completed before your order is processed.

3.4 Payment security

All payments are processed securely through Mollie, a PCI-DSS compliant payment service provider. Luxeparel does not store your payment card details.

3.5 Payment confirmation

Once payment is successfully processed, you will receive an order confirmation via email to the address provided during checkout.

4. ORDER PROCESS

4.1 Placing an order

To place an order, add items to your shopping cart, proceed to checkout, provide your shipping and billing information, select your preferred payment method, review your order and total cost including shipping, and confirm your order by completing payment.

4.2 Order acceptance

An order is only accepted and a binding contract is formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, particularly in cases of suspected fraud, incorrect pricing, or unavailability of items.

4.3 Order modifications and cancellations

Once an order is placed and payment is confirmed, it cannot be modified or cancelled by the customer. If you wish to return items, please refer to Article 6 regarding the Right of Withdrawal.

5. SHIPPING AND DELIVERY

5.1 Worldwide shipping

Luxeparel ships worldwide to most countries. Shipping restrictions may apply to certain destinations due to customs regulations or courier limitations.

5.2 Delivery address

Items must be shipped to a personal address. We cannot deliver to P.O. boxes or parcel lockers. Please ensure you provide a complete and accurate delivery address.

5.3 Shipping method

We use reliable shipping carriers appropriate for each destination country. The specific carrier is selected based on the delivery location to ensure safe and timely delivery.

5.4 Delivery time

Delivery times vary depending on the destination country. Estimated delivery times are provided at checkout. Typical delivery times range from 2 to 5 business days for European destinations and 7 to 14 business days for international destinations. These are estimates only and actual delivery times may vary.

5.5 Tracking information

All shipments include track and trace functionality. You will receive tracking information via email once your order has been dispatched. You can use this tracking number to monitor the progress of your delivery.

5.6 Customs and import duties

For international shipments outside the European Union, customs duties, import taxes, and other fees may apply upon arrival in the destination country. These charges are the responsibility of the customer and are not included in the purchase price or shipping costs. Please check with your local customs office for information about potential charges before placing an order.

5.7 Delivery issues

If you experience any issues with delivery including non-delivery, damaged packaging, or incorrect items delivered, please contact us immediately at shop@luxeparel.com with your order number and details of the issue.

6. RIGHT OF WITHDRAWAL (14-DAY RETURN POLICY)

6.1 Statutory right of withdrawal

In accordance with European consumer protection law, you have the right to withdraw from your purchase within 14 calendar days without giving any reason. This right applies to all items purchased online including sale items and discounted items.

6.2 Withdrawal period

The withdrawal period expires 14 days from the day on which you or a third party indicated by you (other than the carrier) receives the item. If you have ordered multiple items in one order and they are delivered separately, the withdrawal period expires 14 days from the day you receive the last item.

6.3 How to exercise your right of withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw by sending a clear statement to shop@luxeparel.com. You must include your order number, the item(s) you wish to return, and the reason for return (optional but appreciated).

6.4 Return conditions

To be eligible for return, items must be unworn, unused, and in the same condition as when you received them. Items must have all original tags attached. Items must be returned in their original packaging or suitable protective packaging. Items showing signs of wear, use, alterations, or missing tags cannot be accepted for return.

6.5 Return shipping

You are responsible for the cost of return shipping. We recommend using a tracked and insured shipping method as we cannot be held responsible for items lost or damaged during return transit. Keep your return shipping receipt and tracking information until the return is processed.

6.6 Return processing time

Once we receive your returned item and verify it meets the return conditions, we will process your return within 5 business days.

6.7 Refund method

All approved returns will be refunded in the form of store credit (gift voucher) valid for future purchases on the Luxeparel webshop. Store credit is issued for the full purchase price of the returned item excluding the original shipping costs and excluding the return shipping costs paid by you. Store credit is valid for 12 months from the date of issue and can be used for any purchase on www.luxeparel.com or in-store.

6.8 Exchange option

If you wish to exchange an item for a different item, please contact us at shop@luxeparel.com before returning the item. We will do our best to accommodate exchanges subject to availability. Exchange shipping costs are borne by the customer.

6.9 Exceptions to right of withdrawal

The right of withdrawal does not apply to items that have been personalized or made to order, items that are clearly hygiene-sensitive and have been opened or used, or items that have been significantly damaged or altered by the customer. While these exceptions do not typically apply to our standard product range, we reserve the right to refuse returns that do not meet the conditions stated in Article 6.4.

7. WARRANTY AND LIABILITY

7.1 Limited warranty

As all items are pre-owned and sold “as-is” based on their described condition, Luxeparel provides a limited warranty covering only the authenticity of luxury items as stated in Article 2.4 and significant discrepancies between the item description and the actual item received.

7.2 Inspection period

You must inspect your item(s) immediately upon receipt. If you discover any significant issues not mentioned in the product description or if the item is materially different from what was described, you must notify us within 3 calendar days of receiving the item by emailing shop@luxeparel.com with your order number, clear photographs of the issue, and a detailed description of the problem.

7.3 Resolution of issues

If we determine that an item was significantly misdescribed or is materially defective in a way not disclosed in the product description, we will offer you the option of a full refund in the form of store credit, a partial refund in the form of store credit if you wish to keep the item, or an exchange for another item of similar value subject to availability.

7.4 Limitation of liability

Luxeparel’s liability is limited to the purchase price of the item. We are not liable for any indirect, incidental, or consequential damages arising from the purchase or use of items from our webshop. This limitation does not affect your statutory rights as a consumer under applicable law.

7.5 Normal wear and minor imperfections

Due to the nature of second-hand items, minor imperfections, slight color variations from photographs, and normal signs of previous wear consistent with the age and stated condition of the item are not grounds for complaint or return outside the 14-day withdrawal period.

8. INTELLECTUAL PROPERTY

8.1 Website content

All content on the Luxeparel website including but not limited to text, graphics, logos, images, product descriptions, and software is the property of Pulse Collective BV or its content suppliers and is protected by Belgian and international copyright and intellectual property laws.

8.2 Use of content

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from our website except as necessary for your personal, non-commercial use in connection with purchasing items from our webshop.

8.3 Trademarks

The Luxeparel name and logo are trademarks of Pulse Collective BV. Designer brand names and logos displayed on our website are the property of their respective owners and are used for descriptive purposes only.

9. PRIVACY AND DATA PROTECTION

9.1 Personal data

Luxeparel processes your personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian data protection law. For detailed information about how we collect, use, and protect your personal data, please refer to our Privacy Policy available at www.luxeparel.com/privacy-policy.

9.2 Data we collect

When you place an order, we collect information necessary to process and fulfill your order including your name, email address, shipping address, billing address, phone number, and payment information (processed securely by Mollie).

9.3 Purpose of data processing

We use your personal data to process and fulfill your order, communicate with you about your order, provide customer service, send order confirmations and shipping notifications, process returns and refunds, and comply with legal obligations.

9.4 Your rights

You have the right to access your personal data, request correction of inaccurate data, request deletion of your data (subject to legal retention requirements), object to processing of your data, and request data portability. To exercise these rights, contact us at shop@luxeparel.com.

10.1 Use of cookies

The Luxeparel website uses cookies and similar technologies to improve your browsing experience, analyze website traffic, and personalize content.

11. COMPLAINTS AND DISPUTE RESOLUTION

11.1 Customer service

If you have any questions, concerns, or complaints regarding your order or our services, please contact our customer service team at shop@luxeparel.com. We aim to respond to all inquiries within 2 business days.

11.2 Complaint procedure

If you wish to file a formal complaint, please send a detailed description of your complaint to shop@luxeparel.com including your order number, date of purchase, description of the issue, and any supporting documentation such as photographs. We will investigate your complaint and respond within 14 days with a proposed resolution.

11.3 Alternative dispute resolution

If we are unable to resolve a dispute amicably, you have the right to submit your complaint to the Belgian Consumer Mediation Service or to the European Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.

11.4 Applicable law

These Terms and Conditions are governed by Belgian law. Any disputes arising from or relating to these Terms and Conditions or your purchase from Luxeparel shall be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium, without prejudice to any mandatory consumer protection laws that may apply in your country of residence.

12. MODIFICATIONS TO TERMS AND CONDITIONS

12.1 Right to modify

Luxeparel reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website with an updated “Last Updated” date at the top of this document.

12.2 Notification of changes

For material changes to these terms and conditions, we will make reasonable efforts to notify customers via email or through a prominent notice on our website.

12.3 Continued use

Your continued use of the Luxeparel webshop after any modifications to these terms and conditions constitutes your acceptance of the modified terms.

13. GENERAL PROVISIONS

13.1 Entire agreement

These Terms and Conditions together with our Privacy Policy and Cookie Policy constitute the entire agreement between you and Luxeparel regarding your use of our webshop and purchase of items.

13.2 Severability

If any provision of these terms and conditions is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

13.3 No waiver

Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer any rights or obligations under these terms and conditions without our prior written consent. We may assign our rights and obligations under these terms and conditions to any successor or affiliate without restriction.

13.5 Force Majeure

Luxeparel shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
